Terms of Service

1. Introduction

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User") and RAMADAN & CO, LTD. ("Company", "we", "us"), a limited liability company organized under the laws of the State of Ohio. By accessing or using the Vibbbes platform (the "Service"), you agree to be bound by these Terms.

2. Eligibility

You must be at least 13 years old to access the Service. If you are under 18, you represent that you have your parent or guardian’s permission to use the Service. You must be at least 18 years old to purchase any paid subscription or credit pack.

3. Accounts, Credits & Refunds

  • 3.1. Credits: The Service uses a credit-based system.
    • Subscription Credits: Credits issued via a monthly subscription expire at the end of the subsequent billing cycle (1-month rollover).
    • Permanent Credits: Credits purchased via top-up packs or granted upon free signup do not expire.
  • 3.2. No Refunds: All purchases are final. Because we offer a Free Tier for evaluation, we maintain a strict no-refund policy on all subscriptions and credit packs. We do not offer pro-rated refunds for cancelled subscriptions.
  • 3.3. Cancellation: You may cancel your subscription at any time. You will retain access to your credits until the end of your billing period.

4. Intellectual Property & Rights (The "GitHub Model")

  • 4.1. Your Ownership: You retain full ownership (copyright) of the code, assets, and design systems ("Output") you generate using the Service. You are free to use your Output for personal or commercial projects.
  • 4.2. Public Projects (Open License): By default, projects created on the Service are Public. By choosing to make your Project Public (or by using a plan that does not support Private Mode), you grant to the Company and all other users of the Service a worldwide, non-exclusive, royalty-free, perpetual license to use, copy, reproduce, modify, remix, download, and display your Public Output. This allows the community to learn from and build upon shared designs.
  • 4.3. Private Projects: If you purchase a plan that supports Private Mode and explicitly mark a project as Private, the license in Section 4.2 does not apply. Private projects are accessible only by you and the Company (solely for administration, safety, or legal compliance).
  • 4.4. Service Improvement License: Regardless of visibility settings, you grant the Company a limited license to use your Inputs (prompts, screenshots) and Outputs to operate, maintain, and improve our artificial intelligence models and algorithms.

5. Prohibited Use

You agree not to use the Service to generate content that is:

  • Unlawful, harmful, threatening, abusive, or harassing.
  • Sexually explicit or pornographic.
  • Intended to distribute malware, viruses, or facilitate cyberattacks.
  • Discriminatory or promotes hate speech.

Enforcement: We reserve the right to suspend or terminate your account immediately, without refund, if you violate these policies.

6. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS". The Service utilizes probabilistic Artificial Intelligence systems which may produce inaccurate, incorrect, or offensive results ("Hallucinations"). We make no warranties regarding the accuracy, reliability, or suitability of the generated code for your production environment. You accept that you are solely responsible for reviewing and testing all Output before deployment.

7. Limitation of Liability

To the maximum extent permitted by law, RAMADAN & CO, LTD. shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability for any claim arising out of these Terms shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

8. Governing Law

These Terms are governed by the laws of the State of Ohio, United States. Any disputes arising from these Terms shall be resolved in the state or federal courts located in Ohio.
